Student loan summons - Quebec

Postby Missteek » Wed Jan 25, 2006 7:16 pm

well Hi there,

Boy am I glad I found this web-site... it is a bit late however, but I got some info that I needed. I got a document, in french, and I think it is a summons to go to court, either in person, represented by a lawyer, or by letter. I received this while I was away in November, and never really acted upon it. I simply read the date this will be going to court in Quebec City ( I live in Montreal by the way), and I spoke to someone who informed me that it is not necessary to go out there, but that i can simply send a registered letter, to be sent out to "i don't know who" but will send to the court and to the lawyer who represents the governement.
I am totally nervous about this. Just like many out there ( by reading some of the postings, I know I am not the only one.. THANK GOD!!) I am going to write a formal letter myself, with some kind of proposal ( i used to pay 300$ a month, but cannot afford that and couldn't back then either..i barely ate or mooched food off my family). Iguess like many, I got discouraged and stopped paying. i did receive a letter from their lawyer earlier last year, demanding that i pay the full amount, which is about 33.000$ ; it all started with about 20.000$. My question is, what do I do after all this? i know that this is my own fault and I shouldn't have been so "delinquent".
What to do? pls help?!!

PS i forgot to mention that today is wednesday the 25th and this is going to court on friday.  ouch..

Hi Miss,

This is a difficult situation you are describing.

You are going to need professional assistancwe with this. I see this sort of thing quite a bit and it requires action to sooth and/or solve. Advice is not going to solve this because it is you that has to navigate through the messy situation. The lending administration and their legal agent is going toovercome your objections and apply pressure. This is where things will become more stressful, of course.

We can help you if you would like but you would have to become a client.

summons Quebec Student Loan

Postby Missteek » Thu Jan 26, 2006 7:16 am

Hi Johnny,

Thanks for the quick response. I left a message on your voicemail last night, but I will call you again first thing this morning. I absolutely do want to become a client! I am not sure now wether I should still write that letter, or go in person to the court-house in Quebec City. I did take the day off in case I was obliged to go.
I have started to write the letter, and have an idea on what I want to say in it, but not sure how to start it...
If I agree to become a client, would you be able to help?

Hi Miss,

I will talk with you and assess the matter first - and then determine what if there is something you can do on your own to soothe/solve the problem. If not,m then we will look at an intervention package that will address the problem.

In the meantime, gather as much information for me as possible.

1. Name of the law firm and agent
2. Information on the lender (Provincial or5 Federal?)
3. General history of payment made to the loan (just an idea - you do not need to provide me with receipts).
4. Name of collection agency that had carriage of the debt before action was initiated.
