hi im hoping i can get an aswer to my problem here even tho im unsure im in the right forums for this .

i live in Que.Canada.I have a wife whos from the uk. she has been here for the last 18 months ands she finaly getting her resident card in the mail.

that said we got all her debts paid off except for an overdraft she had in her hsbc bank account.This is a debt (around 1k pounds sterling) she had before we were married ,as we got married here in canada via a judge.

Now i have my own debts from here like most peeps do that im paying off.I tried to pay off her bank overdraft but its proving impossible for me to be able to at this time.was laid off from the shop i work in and am only makin it by with part time work all this with a 5 week newborn,btw i also have to pay for the hospital fees as she doesnt have a suncard yet.

i was paying HSBC (in the uk) 50 pounds(keep in mind thats around 100 cad) sterling a month plus the 10 doller fee cad to wire the money over there.now she has a 1500pound overdraft. the debt was going down slowly but it was going down(this was when i was workin fulltime).

HSBC decided to take her overdraft she had for last 10 yrs away so they could charge interrest. i felt well oky thats fair she has no income going into the account as she lives in canada(with me ) now and isnt allowed to work yet. The prob is that they are now charging a 15 pounds per month fee cuase she no longer has an ovedraft. my point is i have very little work and even with calls explaining the sitution to HSBC.

i stopped makin payments i need to feed my wife,get diapers,put gas,pay off MY credit card bills etc before asend money to the uk for debt that isnt mine! my wife recently a letter from Metropolitan Colection Services Limited saying legal proceedings will be issued in our country if we dont call them to make a full paymentall this within 7 days.the letter is dated 7 of MARCH 2009 yet i recieved it today the 24 of march ! They claim to be debt recovery specialist who have been instructed to recover the outstanding balance.

now my internet research seem to indicate they are actually the HSBC from the uk in house debt collectors.

so my question can the really come after her here in canada or me as im her husband now ?????? if so what can i do or what could they do ?


keep in mind im her sponser aswell(for her immigration to canada)

my wife currently owes around 960 pounds sterling which is roughly around 2k canadien
keep in mind this is hsbc in the uk. what im mostly worried about is can they come and try to sieze my assets or money from my paychecks etc even tho this debt isnt mine.

frankly i tried to pay off her debt but they were rather unreasonable with me n wouldnt work out a formal arrangement with me so i just kept sending money into her account evry month.when i started this she owed about 1300 pounds last i checked it was 960 or so.

hi im still looking for a reply to my situation , heres an update ive ignored a few letters from MCS and someone called my wife while i was at work. this person told her she was from Bluestone Law International.

she also got an email with this address for the law firm :Bluestone Law,Ltd.

theres also a fax and phone number in what i assume is a usa number, fax: (240) 744-4774


now does a law firm like this follow the same rules as debt recovery agencies ? can they call us from outside of quebec? etc

i desperately need answer and help on this before i decide what i need to do
